Andrew Tate’s US lawyer says the influencer is sick in a Miami jail cell and has asked for medical treatment multiple times without getting any. On Oct. 21, the lawyer, Joseph McBride, wrote that Tate, 39, is sick after 95 days in what McBride called “a damp cell.”

The plea landed a day after Tate’s own public posture pointed the other way. A post on his account the day before, dictated through his lawyers because he has no phone inside, read: “In jail, you have food. You are not on fire. You are bored, but you are okay. So why are you suffering? The only torture comes from your own mind.”
Andrew Tate has been held at the Federal Detention Center in Miami since July 18, when US Marshals arrested him and his brother Tristan on a British extradition request.
McBride named no illness, but said Tristan is down 13 pounds and Andrew 8, and warned he would “sue FDC Miami into oblivion” if treatment doesn’t come soon.
Britain’s Crown Prosecution Service has authorised 42 counts against Andrew, among them rape and trafficking, alleged between 2010 and 2017. He denies them all. A judge refused bail on Sept. 9, calling the brothers “quintessential flight risks.”
In 2023, when a doctor’s letter in Romanian custody flagged a lung lesion, Tate answered: “I do not have cancer… True warriors are scarred both inside and out.”
Prosecutors say the brothers are in the jail’s special housing unit for their own protection and that their conditions are “reasonable, constitutional and within BOP’s discretion.”
